Is swerving in your lane to warm tires a chargeable offense? I was flagged down yesterday by a policeman and given a warning that it was. I was in my lane, with no traffic and within the speed limit.
This might be a question for Randy.

I did the same thing today with new rear tire and wondered if they saw me what they would do. They could always say it was reckless, but I would go to court and beat it.

I kind of do the same thing but to wear the tires more evenly, but if your in the lines, I don't think you can get a ticket that would hold up in court!

On my way to work there's only a couple of corners that make the commute a little exciting. Not that I'm scraping any pegs but I do like to have the sides a little warm.

I do that often to try and ward off SMIDSY wrecks with northwest drivers who might as well be operating their cars blindfolded. If I get pulled over, so be it.

I would think it would be a reckless driving ticket.... that's funny you should say this cuz I do it everyday when I go to work but in my neighborhood....... just to get whatever shit is on the sides of the tire when I turn onto the onramp. The cop was probably thinkin you were texting or sumthin ;)
What was the warning??? and why did he pull you over? Was he a motor cop?
    Sorry for all the questions..

I got pulled over for swerving back and forth. Just went through a loose pack parking lot and was clearing the tires of any debris with no one around. Got let off with a warning after explaining to the officer. He replied with, "I have a Harley, so I know," which made me chuckle just a tad.

Now, that was a Saturday night leaving a college campus, so he probably pulled me over to see if I smelled of booze more than anything. But annoying none the less.

It could very well be evidence of some offense depending on the jurisdiction you were in. I suppose depending on circumstances, here in BC, that could be considered Drive Without Due Care and Attention, or Drive Without Reasonable Care and Consideration to Others Using Roadway. Used to be Sections 149(a) and 149(b) Motor Vehicle Act BC but probably a new section number by now.

I don't buy into that crap about warming up your tires or trying to wear the ridges off. Bull shit. You are not riding the Moto GP for Christ sake. You are just being a fool. But I do buy into coming off a dirt road or dusty gravel road and making a couple swerves from side to side a bit. Even then, I really don't think it is necessary.

You all owe me $400.00 for my consulting fee. Minimum four hours call back at double bubble with base rate of $50.00 per hour. Send me your paypal account info and I will send you all a bill.

    Every time you're pulled over...
Get your helmet off quick, apologise, be humble & polite and hopefully just accept a telling off.
Much easier than arguing the toss, getting a ticket and trying to fight it (successfully or not) in court...

Just a verbal warning, he didn't quote any specific law but did say it was a chargable offense. He was a motorcycle cop and understood my reply of warming up the tires but said to stick to the back roads when doing it. I was on what I would consider a back road, but getting closer to an intersection at a main road. I only replied to his question and nodded as he scolded me.
Him and his partner got on their Harley's and followed me for a bit on their way downtown.
Glad to be without a ticket. I do find that the tires work noticeably better when warm, especially on cool mornings.
I'm lucky to work at the end of a quite dead end road with some of the only good curves in the area, my 2 minutes of GP glory.

Rob you are just a cop magnet!
They cited you last year because you didn't slow down fast enough rolling into a small Quebec village with a population of 6!!! :hss:

But seriously, you do seem to attract them. It must be that space ship thing you ride!

In this case, I think they were bored and you were an easy target to hassle. Personally, I think that when you see a real motorcyclist ( not one in flip flops and a tank top) that gently swerves back and forth a few times in their lane with no other traffic in the area to spook, you give them a wave and ride on cause you know why they did it. If your are dragging a knee and scaring people or just scaring people or endangering them it's time to step in cause that is why we have laws.

Clearing the sides of the tire's is actually a good idea-some junk could be on it and then if you need the sides of tire will work perfectly.

That was a tough one to take, can't even call it a performance award. Those Quebec cop's had almost a whole parking lot full of Ontario plates as townies were zipping right in front of them at double the speed limit. We were all nailed 3/4's of a KM from town exactly were the speed limit changes. Right out of a Dukes of Hazard show and I never even got the chance to meet Daisy.
Guess I shouldn't complain, it's the only one I've gotten on a bike and l've definitely deserved a few more.

    Section 144(1)(a) MVA now

Though it would seem that proving either of those for "swerving" inside your own lane would be difficult.

Might be different in Canada but in my 1st hand experience dealing with tickets in court (on both sides of the ticket) you have to be able to quote the law easily and be able to articulate why you were "warming your tires". This is all of course whether the judge will allow you sufficient time to speak. if it is a small bench trial system like we have here in GA then the judge will ask the cop 1st what happened and then ask the "offender", which is you, your side. Do not sound snyde or cocky when speaking, but make sure you can explain the importance of "warming the entire surface of the carcass for maximum traction for safe operation of your motorcycle in the current conditions." "A tire that is properly warmed has a 15-20% better chance of being able to avoid obstacles, or make an emergency manuever if the opportunity presents itself." get what i'm saying? If that particular law is grey in anyway about the offense it should be easy to have the ticket dismissed or, at a minumum, have it reduced in some way.

of course it always helps to have a clean driving record, that is fairly free of infractions. if you are on a 1st name basis with the law then get ready to pay up.
