Like most things in law there are certain and at times, many conditions that have to be present. Here, you can be convicted of Impaired driving even with a .011 reading. We have two offenses. Drive While over .08 and Impaired driving. If it can be proven that as little as .011 BAC is enough alcohol to impair a persons ability to operate a vehicle, then the elements of the charge has been met and you will be convicted.

Years ago we charged a person for Impaired when we found him at roadside in his corvette huffing gasoline. He plead guilty. Would have been interesting to see that one go to court because the law is written so as to be impaired by Alcohol or Drug. Gasoline is neither.

@ BB. Years ago US beer was considerablyweaker than ours but now it is pretty close. Most of our lagers and ales are 5% where most of yours are 4.5. Hardly noticeable. What movie was that Comicus. I am not much of a movie goer but John Candy and Pearl Bailman. I gotsta see that whole thing.

 

It's called Canadian Bacon. I love this movie despite the fact it's written/directed by Michael Moore and got really poor reviews. It's about an unpopular American president (Alan Alda) trying to start a Cold War with Canada to improve his approval rating. I think it was the last movie John Candy made.
