First ticket on the VFR - Advice?

BB... I am not an attorney and I don't really know or care how it works, that's not my job. My job was to pay the fine as directed, then check my DMV record to make sure I was showing a parking ticket and not a speeding ticket. I posted the link to the law firm a couple posts back... if your inquiring mind just HAS to know how they do it, feel free to call them yourself... or for all I know, it may be something specific to Nevada or Vegas and you can Google it. I have better things to do, apparently this is keeping you up at night, so I would suggest taking whatever steps you feel are necessary to satisfy your curiosity. I don't have the time for this nonsense. I'm happy with the results and that's as far as I need to go.

As for my cop friend with the second ticket... "friends and family" court is the first Wednesday of every month, so he will be going to the judge next Wednesday for me with my ticket. I have no doubt he will be successful in handling it satisfactorily for me.

All that really needs done is to show some evidence that anyone can have a moving violation reduced to a parking violation by this attorney or any other any place including Las Vegas, Nevada or any court save the the one where the attorney of record will not appear.

Or you can scan and post the transaction deleting the particulars of name, address ect. I am sure you have that or can access it from the Nevada, DMV.

What has happened IMO, is that you incorrectly posted a legal procedure that does not exist thinking it might be a good idea and it became fact in your view. So far, there is no evidence to the contrary.

Another question someone might have is if this "procedure" is as effective as imagined, why not use same for this current alleged violation and call the attorney. Too many parking tickets perhaps?

My brother is a lawyer, and he's taught me a lot over the years. I also have a friend who is a criminal defense, trial lawyer, and he's taught me a lot, too.

Within a given, local jurisdiction, private "defense" lawyers, prosecutors, judges, magistrates, etc.... the fact is that not uncommonly, many or all of these folks (when they're not in the court room) are actually friends, golfing buddies, etc. In other words, there may be a "Good Old Boys" culture and dynamics which come into play. Is this corrupt? Well, not exactly in most cases, but there is often a fine line at times.

When one hires and pays the fees for a local and "well connected" attorney, what you are often actually paying for is unstated influence and respect for judicial power at a local level. Judges and magistrates often tend to look down upon defendants who either appear or don't appear before the court without private counsel to represent themselves when their name and case number is called out on the docket. Appearing without counsel may be viewed as an affront to the majesty of the court and an invitation to a swift and harsher penalty.

Among other strategies, a private attorney is often in a good position to request such things as a repeated continuance of the case (thus dragging things out indefinitely), and assuming good behavior over a period of time, the private defense attorney will (often behind closed doors) file a motion to reduce or throw out the charges if all court costs are paid, and you keep your nose clean.

Within the context of this particular thread, I find there to be some very concrete "black & white" thinking, rather than more sophisticated abstract thinking...

BB - I believe her story. Why? Because I have had a moving violation changed to a non-moving violation in Cincinnati, OH. When pulled over the cop said he could write me a ticket for speeding, changing lanes in an intersection, and failure to signal a lane change. I was very polite and he ultimately wrote me a ticket for not signaling a lane change which was ironic because of the three things he said he could cite me for, not using my turn signal was the one he was wrong about.


So I went to court. When the judge asked me how I would plead, I said not guilty but that I would like to work a plea with the DA. So he let me go talk to the DA. I told her that I was willing to plead guilty to a zero point violation. After looking at my proof of insurance she said okay. I was expecting her to suggest speeding 5 MPH over the limit because in Ohio 0-5 over the speed limit is zero points. To my surprise, she suggested pleading guilty to an expired registration. I said OK. I went back before the judge, he asked the DA what I was charged with. She said expired registration. The judge asked the cop if he agreed. He said yes. The judge asked how I would plead. I actually had to think about it for a moment because if I said guilty I would actually be lying in court since my registration was not expired, but then I thought that the DA and cop had already lied, so if it was good enough for the legal system, it was good enough for me. I said guilty.


I never even considered using an attorney. I had no tickets on my record for the last three years. I had insurance. Even if convicted of failure to signal a lane change I would only get two points. The funny thing is that if the cop had written me up for speeding, I probably wouldn't even had gone to court. The fact that he cited me for failure to signal just galled me. I ALWAYS use my turn signals. Even when pulling into and out of my own driveway. Even when turning into a parking space in a parking lot. Even when it's 2AM in the morning and I'm the only vehicle on the road.

 

After entertaining myself reading the 702 biker forum link, which one has to admit is more fun than watching TV when you have nothing to do and can't sleep, it seems that VFRChicks attorney may actually be able to work magic. He does reference actually turning a speeding ticket into a parking ticket. His most recent update cites recent changes in the attitudes of the local courts he serves, to the tune that this courtesy he has enjoyed may be going away, and he may not be able to be so lucky for his clients as he has been.

It doesn't seem too surprising that his turning lead into gold may end soon, since it seemed like a mighty big favor to grant someone even if you had to pay above the usual fine for speeding to get it done.

What was surprising was how it got worried to death here by Billy.....oh wait, nevermind.

 

Best advice flip the cop off next time and run for it:vtr2:. Ticket problem solved. The bike is now in the impound yard.

I bet this Vegas lawyer dude "LAWYERS WHO RIDE" is working on some judge to turn a parking ticket into a hit and run, DUI or 120 in a school zone ticket for the uber macho types so they can tell all thier friends "Me Bad Boy!" "Got tat to prove and night in cell with Big Bubba in bottom bunk."

IMO you do have to admit I am more fun than changing plugs in a VFR.

 

Dunno what the procedure is in any other state, but here in New York, at least in this jurisdiction, the question of whether you are prosecuted for a moving or non moving traffic violation is entirely at the discretion of the DA or magistrate. And indeed, a good lawyer, a sympathetic DA or magistrate or, as in my case, an almost overwhelmingly charming character, may result in the reduction of a moving violation to a non moving violation. The $$$$'s you pay may not change, but the license points and insurance increases don't become a problem. Never had a point on my license despite the local magistrate and I being on a first name basis at one time because I saw so much of the courtroom!

 

I've fought several tickets in court. Show up early, try to talk to the officer prior to the court proceedings. See if he'll work with you - most will. Sometimes they'll even talk to you first. If this isn't the case, go into the court room and when the judge asks, tell him you don't mind paying the fine but you are trying to have any points removed. The fine is not such a big deal as the points will be to your insurance prices. I've had every ticket that I fought either reduced or thrown out. Good luck!

Sorry dude, calling BS on the whole thing including the anecdotes until some actual case law or court records show that you ain't doin shit but fishing.

With all this ability to get these moving violations changed to non-moving violations. It might be the right thing to do to share the procedure instead of keeping it a deep dark secret. Even the harleydoods might want to know since they get moving violations for things like "impeding the normal flow of traffic."

This is a brilliant defense. I get up in front of the judge and tell the sucker there ain't no way I could have been going 120 in a school zone when if fact your Honor dude. I have a receipt for an order of deep fried chitlins from your cousin the mayor's deep fried chitlin emporium. At the time of the alleged offense, besides all them rat kids was in class.
