    It was the SAME driver!

    Nothing better to start the New Year with not one but two DUI charges and a fleeing the scene of an accident charge as well! This happened in Denver PA

    Ridiculous behavior on the part of the driver. Ridiculous behavior on the part of the police dept. This is the first time I've heard of a DUI suspect being set free while still intoxicated. Here in CO. if you get the failed roadside, you're either staying in the hospital while toxicology is completed or, if you choose to blow and it's positive, your headed for jail or detox untill you're .000 B.A.C. The court may have their hands full with this one. The drivers actions are in no way justified, but if it were me, I'd be putting up a fight on the second charge. Maybe even a negligence lawsuit to use as leverage against the first charge. That said, thankfully no one was hurt and hopefully this guy is dumb enough to take the plea that the courts will offer, loose his license, and re-think his driving habits. Imagine the shit show that this would be for the police dept had he killed someone on the second go around, after he was set free.
