The law: on potholes!!!!

    So heres the deal, I am going to try not to use foul language for this story...To sum it up I was pinned by a small SUV and two trucks trying to turn out of Wal-Mart. Stopped on an incline with two trucks right on my tail, the SUV pulled out with me close behind...(its an incline) and bam..I hit the biggest F*&king pothole in the city. I did not drop it but scratched the s*&t out of the bottome fairing...I went back and took some pics about 20 minutes later..The city says I will have to file wreck incident/police report in order to seek damages..Same thing with Wal-Mart..In which case a no fault accident will appear on my driving record, which can cause a raise in rates and allow for me to meet my huge deductible and get it fixed myself..either way an increase in rates is inevitable...Now I'm no stranger to the state troopers in my area...Going through high school and college in the same town aint easy on a sport biker...So without anymore stories here is the beast of hole in 5 mp sharpness...I noticed the hole to be close to 11" deep 2 1/2 feet wide my almost 3 feet. After witnessing a lexus, 2 new mustangs, and a little civic hit it..I almost didnt feel so bad....>>>Im too pissed to upload the pics and too tired to erase this day from the forums..I will post later

    I am still having difficulty uploading the pictures of the pot hole and the damage it did to the VFR...I will try again at work.

    those things can be buggers... I have not hit one that big, though. I did take the guys on a road the other day that was pretty bumpy, though. I'm sure they'll all chime in once their teeth stop rattling...

    Push it all the way in northern ireland/uk if I was to damage my motorcycle/car because of a pot hole the DOE (Department ot environment) road traffic service would have to fix the problem, You did the right thing by taking pics of the hole and if u can get a ruler and take a pic of how deep it is....

    That road at Reg's had more holes then pavement. I grew up in Pittsburgh which at one time was officially the pot hole capital of the US. There should be a way to get satisfaction without getting dinged on your insurance. You might give your agent a call.

    I agree, I would pursue it. They (and you) are lucky you didn't get hurt. Good job. I would remind them of that.

    OK, whose property is it? Wal Marts? File under their liability insurance.

    The city's? They have liability insurance, too, just a little harder to find out where to pick a fight at. Start at the City Attorneys office and work your way to streets and maintenance. Somebody owns that strip, and its NOT an accident for you to file on.

    Get on the phone.

    i didn't think that road was all that bad, reg......i thought we were able to do respectable speeds..........hey...where did everybody go? Adequate advanced warning was given to everyone prior to the ride down that road, i guess some didn't take the warning all that serious......$2500.00 worth of suspension has it's advantages......

    Pot holes suck, really. They suck the worst on low speed manuevers (the wheel sinks further in before it reaches the opposite lip). Though potholes at speed, it usually helps to accelerate over them, if you have no other option you can usually get away with having the front wheel glide over it (the front won't fall into the hole as far as if you were braking/slowing down over it), just prepare for the rear to be not as gentle.

    just remember to wright down everything said between them and u and make sure that any e-mails or letters you send or get sent keep them all...

    ah the therory of pot holes, manitoba style(these are not the official reasons for why potholes are not fixed): they are an effective method to reduce street racing of most if not all natures. They are also used as feed back devices for the town involved to find out if a hole is reported and to measure the repair crews response time to fix it. If a pot hole in a most in appropriate location is not repaired in a timely fashion then a concerned resident may save the town the cost of filling the hole with gravel by filling it with dirt or sand from an unknown source. As asphalt is expensive, pot holes are left to get as big as possible so a section of pave can be done all at once at a reduced cost due to not moving the equipment from spot to spot.


    I hope you had a reference to how big that hole was and be a squeaky wheel.

    I hit one on my RR that I had. I never went back and measured, but the now wife & I hit it at about 30 - 35, and I swear it screwed up my head bearing. Every time I had to use the break hard you could feel it vibrate. I should of gone back and filed a claim, but never thought about it. I had the rotors checked for flatness, fine. Bought new ones, still did it. Had the wheel checked for balance and straightness, was fine.

    Just make sure now it didn't do the same thing to your bike.

    Up here, if a pot hole has been reported it is now the responsibility of the whom ever that is, and they need to have it fixed in a "timely matter". Obviously it's up to you to determine if the pot hole was reported and if they had exhausted their "time" to repair such pot hole. Most pot holes are reoccuring in nature due to quick patch jobs rather than a fixes. If you wanted you could summon the repair records and see if there was a "trend" that they may have been able to predict and "failed" to do anything about it. All this will require a person on the inside of the whomever is responsible for your roads and willing to get canned or a lawyer which will cost you money.

    We used to have a pot hole on a bridge up here that reoccurred twice a year, I called them up and stated the above and they promptly patched it with concrete instead of asphalt that evening. Liability is a bee eye tea see H, you just gotta make them aware of it.

    I have never hit a pot hole big enough to cause damage. I usually see them and avoid them. Why was it you could not see this one and take evasive action? Was it because you were too close to the vehilce in front of you?

    Don't get me wrong people. I hate pot holes as much as anyone. I more hate the rubble around them than the hole itself, cause I have just about always been able to see them in time. And as Jason said, the cold patch they use in the spring is only a temp measure until the summer rolls around and a proper fix can be made. Being from Winnipeg, Manitoba, the real pot hole capitol of the world, I understand potholes and people's frustrations with them. But you are the one drivng. Just remember next time you are following another vehicle out the lot close like that, the pot hole could be big enough to knock you off your bike, and the truck behind you could be following just as close. Who would win that one?

    Now if they could do something about those old ford vans coming around blind corners in Atascadero, I would have it made.

    Pot holes I can live with but the amount of gravel on the roads this year is awful. I will have to wait until the end of April before the City of Calgary starts cleaning the streets. Just love the winter.
