    High court affirms gun rights in historic decision

    WASHINGTON – Silent on central questions of gun control for two centuries, the Supreme Court found its voice Thursday in a decision affirming the right to have guns for self-defense in the home and addressing a constitutional riddle almost as old as the republic over what it means to say the people may keep and bear arms.

    The court's 5-4 ruling struck down the District of Columbia's ban on handguns and imperiled similar prohibitions in other cities, Chicago and San Francisco among them. Federal gun restrictions, however, were expected to remain largely intact.

    The court's historic awakening on the meaning of the Second Amendment brought a curiously mixed response, muted in some unexpected places.

    The reaction broke less along party lines than along the divide between cities wracked with gun violence and rural areas where gun ownership is embedded in daily life. Democrats have all but abandoned their long push for stricter gun laws at the national level after deciding it's a losing issue for them. Republicans welcomed what they called a powerful precedent.

    Democratic presidential candidate Barack Obama said merely that the court did not find an unfettered right to bear arms and that the ruling “will provide much-needed guidance to local jurisdictions across the country.” But another Chicagoan, Democratic Mayor Richard Daley, called the ruling “very frightening” and predicted more violence and higher taxes to pay for extra police if his city's gun restrictions are lost.

    The court had not conclusively interpreted the Second Amendment since its ratification in 1791. The amendment reads: “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.”

    The basic issue for the justices was whether the amendment protects an individual's right to own guns no matter what, or whether that right is somehow tied to service in a state militia, a once-vital, now-archaic grouping of citizens. That's been the heart of the gun control debate for decades.

    The answer: Writing for the majority, Justice Antonin Scalia said that an individual right to bear arms exists and is supported by “the historical narrative” both before and after the Second Amendment was adopted.

    President Bush said: “I applaud the Supreme Court's historic decision today confirming what has always been clear in the Constitution: the Second Amendment protects an individual right to keep and bear firearms.”

    The full implications of the decision, however, are not sorted out. Still to be seen, for example, is the extent to which the right to have a gun for protection in the home may extend outside the home.

    Scalia said the Constitution does not permit “the absolute prohibition of handguns held and used for self-defense in the home.” The court also struck down D.C. requirements that firearms be equipped with trigger locks or kept disassembled, but left intact the licensing of guns. The district allows shotguns and rifles to be kept in homes if they are registered, kept unloaded and taken apart or equipped with trigger locks.

    I don't get it.

    I mean, I can understand their argument, that more guns in homes mean more gun thefts, and more guns in the hands of bad guys.

    But... If I'm the bad guy. Right now I'm thinking "Well, this law abiding person can't have a gun, but I'm a criminal, so I do have one. I can break into this house with no worry."

    Where now they will be thinking.. "If I break into that house, I might get my ass shot!"

    Here in Utah there is no gun control. And the concealed weapon permits are pretty easy to get. I would wager that 80% of households have a gun. We don't have a lot of home invasions either.

    That was some good news! But like Shorty, I am a little disturbed that the decision was that close. Today's political landscape is full of those that feel that the Constitution is constantly open to new translation and that's just not the case. Sure there can be amendments made, but if in the end the amendments make the original document null, then there will be no more republic.

    The original document was designed to protect civil liberties and control the government. Not the other way around. Rarely do you see laws being passed or bills signed in that are designed to obstruct a politician in any way other than something regarding money, either campaign finance or embezzlement scams. But our founding fathers knew how governments could get out of control and designed all of the checks and balances in place to avoid just that. Now go watch c-span and see which sport our congress is overseeing today! Baseball, football, thumb-wrestling, next thing it will be elementary school hop-scotch.

    Sorry for the rant, but that was some good news about our gun rights!!!!

    Definately good news. And I agree with Shorty too. That is a bit disturbing. Though I may be misunderstanding the whole thing, I thought this was more about hand guns. The upholding of the 2nd Ammendment just goes to show (and prove what everyone should already know) that the rigth to "bear arms" includes a hand gun, not just a rifle. As for the four who were against.....well they are entitled to their interpretation too, even in if was incorrect and they go over-ruled.

    I guess I am in agreement here as my take on things usually goes to whichever way allows more freedom. I realize some regulation is necessary as there are a lot of idiots, but I sure hate being reduced to the LCD in our legislative policies generally.

    This is a step in the right direction, that's for sure. Too bad in NJ, it's STILL illegal to use deadly force to proctect oneself. To put it in very clear terms, the CPRofNJ expects you to cower in fear if your home is invaded. You are not permitted to confront an invader even if you are in grave danger. If you take matters into your own hands & introduce the invader to a .357 Mag Federal Hydashok, you WILL go to prison with murder charges. No, I am not exagerating.

    Political landscape is still bent the wrong way . I is full of a bunch of DoGooders and MeanWells thta think the know what is best ofr the rest of us and that most people aren't educated enough to make thier own decisions.

    The sad fact is that most Americans do not understand politics or the roll they play in politics.

    I am from No. Va and remember when the Ban went into effect. My relatives had to ship their guns out of the district to live with us to avoid having them destroyed.
    I also have watched the city's crime rate climb ever since and for the past 20 years DC has been in contention for top honors for Murder Capitol of the USA. All of which was lower before the Ban.

    I think and hope no VFR owners have guns or other weapons....Here, in Europe the Law permits to have a gun only if you do a certain job (risk to be robbed...). Personally, I hate weapons, I never had a gun or a dangerous knife, despite the fact I live in a country (Italy...) where the delinquency rate is rather high...
    On my personal experience, if you have not a gun in your pocket you may hope to survive to a robbery loosing some money, as it happened to me, but if a "bad guy" notices you have a gun he will shot you before you notice him....
    Well, let's hope a better world without guns...

    Right or wrong this was the first time since 1791 the SC has come out and definitely stated the second amendment's intention. Up to now they've always danced around the issue.

    DC has had this ban in effect for 30+ years, so there must be some solid data on how many homeowners were being murdered every year in their homes by these criminals, and maybe some pre-ban data to compare? In all the reporting I haven't seen any statistics, it would be good to know if they've solved a problem that did or did not exist.

    there are statistics. and the number of murders has gone up. it hasn't doubled or anything dramatic but it has risen... it will be interesting to see if it goes down after this.

    you should hear the dirt bag mayor of Chicago speak. very disturbing

    SCOTUS Ruling

    I just ordered some more hardware last weekend, a small .380 automatic pistol for concealed carry and a home security 12 ga. pump anticipating another wrong-headed liberal ruling from SCOTUS. Finally one went the right way, though a little too close for comfort. Rememebr "...from my cold dead hands...":bootyshake2:

    I knew we wern't the only ones who wanted to keep our rights. I would hide mine before I gave them up. Some date back to the 1800s, so I'm happy. Lets go shoot something. And there's almost nothing sexier than a beautiful woman with a gun!!!! :wink::wink:
