I know exactly what I would tell him if I were the courts.......Driving any motor vehicle in Ontario is a priviledge, not a right. If you are not willing to abide by the requirements for legal operation of a motorcycle, that priviledge will be revoked. That will will be $110, Mr. Badesha, please pay the clerk on your way out.

I don't agree with helmet laws but it IS the law and as noted, freedom of religion is a right, driving is not. I see gear as common sense but there are those who don't and they should be able to ride as they like so long as the rest of us don't get their medical bills. Personally, I'd have an exception in the law, it'd allow people to ride without helmets if they've got personal insurance because doing so would forfeit their access to national healthcare coverage...

I wonder if he's a US citizen. Only citizens have rights. All others have privileges.

He is of course lying for his own convenience, while a Turban does show a visual devoutness to the Religion my understanding from working with practicing Sikhs who don't wear Turbans it is not mandated by the religion itself...

Have also seen Sikhs on motorcycles wearing a white nobbie cloth under Helmets which I'm guessing is a Turban substitute when wearing Helmets as required by the law here.

required to wear a turban, but not required to ride a motorcycle. case closed.
I wonder when the worlds societies are going to learn that accommodationalism isn't the answer. people come to your countries and towns not based on what newcomers want it to be, but for what it already is. always changing to accommodate someone means you lose your identity as a community and country at the sake of "evolving with the times".

There is a precedence permiting Sikhs to wear helmets into battle, maybe SHOEI could make a special Helmet to allow for the hair knot while riding ?

Im of the opinion that this crap needs to stop somewhere, and hopefully a smart judge will herald the beginning of the end of frivilous crap litigation like this. Adapt to where you move. It is just your country, and the laws are not made just for you!

In this case, no one wants to pony up the HUGE amount of dough to cover your medical expenses when you whack your noggin without a helmet on. I agree with the above. Forfeit your medical coverage if you dont want to wear a helmet, or dont ride a motorbike.

This is a melting pot, but one with an identity its own. People are presumptuous and rude to infer that their culture/customs are superior or should suprecede the customs and the laws already in place.

If my religion mandated that I never stop for red lights on tuesdays, I think we would have a problem too.

The real nonsense with this is that the Ontario Human Rights Commission took up his cause when they had no basis for intervening. If you ride a powered two-wheel vehicle in Ontario then you are required to wear a DOT approved helmet. Case Closed.

What is even less comprehendable about this entire matter is that the Crown Attorney's Office (that would be the DA to our US friends) tested the use of a turban on a track hoping to defeat the matter by proving that the turban would unravel at highway speeds and thereby present in court that the wearing of same would be a hazard. Of course it didn't but that isn't the point of the problem anyway. Makes you wish you could elect Crown Prosecutors in this country rather than have to suffer the indescribable stupidity of some of them. Our CDN tax dollars at work.

This kinda stuff just makes me sick. Like was stated, you have a right to wear a turban/hat/head scarf, but not a motorcycle unless you abide by the laws. This reminds me of that lady who was suing the Florida (or US) government because they wanted her to remove her Burqa during her ID picture. Can you imagine trying to ID or convict a person who commited a crime while wearing a burqa? It would be like "no officer, that was not her, she has a "red" burqa on, not a "blue" on like the criminal had" case closed! How in sam's hell could you ever dentify anyone? All this PC crap is garbage. :puke: It just gets pushed too far. Either abide by the laws, or don't enjoy all of the perks, or better yet stay in your own country if you don't like it.

This was in Ontario C.A.N.A.D.A. We are not US citizens for the most part. But your sentiments in your message are bang on. And for a rider to sign a waiver so we don't have to pay is medical bills for not wearing a helmet is only a very small portion of the cost to our (and your) society. The cost of investigating for police, coroners, Traffic Safety agencies and the like goes up ten fold when there is a serious injury or death. Wear the friggin helmet, and other protection for that matter. This guys is probably a nice guy. If he lives long enough, maybe some of us will meet him.
