    This sucks... being in the water system Biz and know all to well problems like what he's got going on, Well I'd be drinking too. Just like VA said, stay home.

    Stick to your guns! Don't give it away. You don't have to feed it for the next year, so it won't cost anything to keep it around. Just ride it around the yard once a week and all will be back to normal before you know it. :biggrin:

    Good morning guys, thanks Nailer for the very gracious idea, but honestly I would feel pretty uncomfortable accepting help for a situation that I myself caused.

    Other situations like what happened to VMAN I think are more appropriate. Don't mistake my post as not being thankful for the idea, I think I would just feel more guilty than I already do.

    If I must sell what I love be it my bike or my stocks(which I love to handle!) so be it. When you make a mistake you pay one way or another.:smash:

    Now help finding a buyer, that I would certainly accept!!!!!!

    Yes we all make mistakes and its not like you murdered someone so I see no reason for anyone to give up a passion such as motorcycling

    punished more than is justified? Driving drunk, has been established as being fairly dangerous to the rest of the driving public. What do you want? a $10 fine and a ride home? And for a 2nd offender? 20% over the legal limit?

    I agree that donation of funds is a preposterous suggestion. However, as a second dui he's going to pay thousands and thousands of dollars, and probably lose his license for some time. Noone was hurt, he didnt cause an accident, and .10 isnt drunk in my opinion. Buzzed, maybe.

    Before this spins out, please read my response that I would not accept any funds even if offered. Also, yes I was over and yes I had one 9 years and 8 months ago so in that I deserve to be punished.

    In my own defense I had 3 drinks and 2 beers in 4+ hours with no dinner and at 180lbs I was over, I thought I was OK, and I was unfortunately VERY WRONG. As to my intention I didn't think I was illegal, but that only matters to the prosecutor in terms of intent not reality.

    Lets keep this civil as I have opened up to the community not only to vent but to help you guys not make the same mistake I did, so no punching bag please.

    And RW, if I sell it it probably WOULD be a 5th Gen:biggrin:

    Sorry to hear of your misfortune and poor judgment. However, I think like some of the other posters, you should lawyer up because that process alone will be enough punishment for you and I hope for sure that you have learned your lesson as a 2nd time offender (well, innocent until proven guilty). Better not make it a third time because it could be your life or an innocent person's in jeopardy.

    I have served on jury for a DUI offense similar to yours where a man was close to the limit. We ended up being hung because we couldn't agree. These charges can ruin people's lives and livelihoods and I just believe in doing that to someone because they had a few at dinner or after work. And as for people putting you down and calling you an idiot......hypocrites...plain and simple. We have all had a few and driven somewhere or, if you don't drink, done other illegal things like going 100mph on our bikes.

    First please remember when you post something everyone will tell you how they feel if you like it or not and those that place them selfs higher up than others well they too have made mistakes but cant admit it,
    I too have made mistakes myself and years back i gave my bussness away and sold my bikes and prized GTX and roadrunners thinking that those days were over and looking back it all should have been handled totaly differantly,
    while i do understand where your at and in need of cash if you want help i will donate some too.
    but stick around awhile we enjoy having you here your our friend good luck hold on to your family tight take care

    VA, Looks like the system is punishing you as the law allows. Did the judge sentence you to being beat up by your "friends"? We've all done stupid things. Sometimes we get caught and sometimes we get away with it. It'd be nice if we had a rewind button on life. I'm currently looking for one myself. If I find one, I'll loan it to you and you can make all this go away. It sounds like you feel bad enough without being beat up here.

    I can't believe that so many people are trying to bust you in the chops for being .10 BAC, if you ask me it was just a simple case of poor judgement. At that level you most likely didn't even feel slightly impaired let alone drunk.
    I do understand that your reflexes might not be up to par, but you were in no way being a drunken idiot out there taking chances with other peoples lives.
    That BAC calculator is dead wrong too. I would like to see a 180 lb. man drink only 3 beers in 2 hrs and test under .10... Does anybody have access to a breathalyzer so we can put this to a test? Anyway, I don't feel you endangered anyone's life that night. And you sure don't deserve the criticism and hard time you are getting by some of these guy's. I have personally seen too many idiots out there who were visibly drunk or drugged up endangering the lives of others, I only pray that we all start to make better decisions regarding our responsiblities to others and the possible tragic outcomes. I am not going to condemn you VARollOn for a poor decision that only brought trouble your way without affecting anyone else. I don't believe you were impaired enough at .10 to be a hazard to anyone else, let alone possibly cause anyone's death or bodily harm.
    I wish you well in these court proceedings and hope that you have learned from this. (I know that you have) Thanks for trying to get us to think twice before we end up making the same stupid mistake.

    A topic as emotionally charged and difficult as this one brings out strong reactions from people which is appropriate. I knew some folks would judge me based on the limited information that being part of a community like this allows, but knowing what this has done to our family for an avoidable but not catastrophic mistake on my part I felt it could be of use to other members, and for that I was willing to take some internet abuse.:violin:

    You can ruin your life in very short order be careful gents. I know of an acquaintance recently whom got arrested and charged with a felony for passing(not even speeding) where there was no dotted line, not a double yellow, no line at all. The car was even people he knew, and they knew he was passing. Never voting forever for a pass, after 9/11 the Police are not kidding around.

    Thankfully most judges and prosecutors are pretty even handed and do take into account severity of one's offense when dispensing the state's form of punishment. The case is already over, I already did jailtime with some folks that I would have cared to never have met. Being shackled and treated like a total maggot by people whom usually treat me as a citizen is surely an experience I do not wish to repeat.

    The pony in the pile of sh!t is that I have a new goal in life, to never spend one more minute in any institution. My wife is the one person who has tried to get me to keep the bike, I think more for knowing how hard I have been on myself and not wanting to clip me. I more don't want to look at it for a year all unhappy sitting there faithfully...:lever: Either way if the last 4 years is any indicator, 12 months will certainly pass quickly.
