VA, as far as I am concerned, you are still a welcome member. Sometimes it takes someone to admit a wrong in order to help themselves, not saying you have any kind of ongoing "problem", and for others to kind of take stock of their actions. Look here for more info on Virginia DUI laws, http://www.1800duilaws.com/states/va.asp. This will give you some kind of idea about what to expect. Living in KY, and having heard stories and comments on one of the local news sites, sometimes states, attorneys will plead it down. It's what they do. I'v seen them do it for worse offenses than DUI. now if you had been in an accident while DUI, then it would be another story. Anyway, I wish you the best of luck, hold on to that VFR for a while, you might find yourself in a different mindset in about a month. IMO, everyone makes an error in judgement, be it making a wrong decision or something worse, such as what you did. I am no judge or jury. It's not my place. Sorry to hear abour your house, too. Stress has a way of making one do bad things sometimes. Everyone screws up. I know I have.

    Good luck, bro.

Rich I copied this directly from Danimals response to one of my screwed up off color personal problems posts of which you where the first to respond to I might add.

"Hey man thats what we are here for Free frickin therapy"

If we can help a brother out or through a problem most of us are willing, there is some comfort in perceived anonymity. There are those of us that will give our honest opinions, as you see(good, bad or indifferent), those that have first hand insight to offer & those that will either encourge, condemn or offer there support - Free Frick'in Therapy, to quote a Disney flick " Hakuna Matata" means no worries:wink:

Sorry to hear about your week from hell, I've always liked your responses on the forum and via PM's. I must admit I very rarely drink and I'm not very educated when it comes to alcohol level, so here's a question for those who might have a clue. Last week I had dinner with the wife and had two pints of a local brew, would that put me close to .08 ?

P.S. As for all this kicking a man while he's down, a long haired carpenter once said, Let the one who is without sin cast the first stone

According to this calculator, a 180 lb person would need to drink a six pack of regular beer in 2 hours to hit .08. 2 pints over dinner shouldnt do it.

    http://www.ou.edu/oupd/bac.htm

I will say that while I havent driven near the legal limit in many years, in the past I've done it many times. I never got a DUI, even though I'd been pulled over seeing double a couple times - still don't know how I talked my way out of those instances, I believe everything happens for a reason and I just wasnt destined to go through a DUI.
Noone should be throwing stones at the original poster unless his hands are clean.
Since your last one was almost 10 years ago and you were barely over the limit you shouldnt go to jail, but be prepared to spend lots of $ and lose the license for a time. Good luck and don't do it again.

    OH Dude!

I am sorry to hear about all this "stuff" (S*%&) that happened. I hope it doesn't turn out to be the "max" sentence. Wish I could help you out in some way. You said you have to sell your bike. I would hold out as long as possible. Things tend to work out in ways you hadn't thought of before. Something may happen that will allow you to keep your bike. If that something comes across and you have already sold the bike, you will kick yourself. I don't know your situation, but thought I might give my thoughts. Let us know how things turn out, hope things come around for you. Best Wishes....

VA: Sorry to hear everything bad happen at once. Sadly the DUI could have been prevented. But as someone who has watched people in jail and taken them there for over 12 years, I can say this... You have the right attitude. I believe you are on the right path to learning your leason. Court issued punishment is not always needed for people to learn, simply owning up to and learning from their mistakes is all that is needed with some people.

    So I applaude you.

Unlike the guy that I took the other day who was driving from one side of the shoulder to the other, into the dirt several times on both sides, while his three kids waved out the back window. He told me at the jail that he wasn't even driving. Of course the tape proves otherwise. This was his 4th in 11 years.

You've made two mistakes now, don't turn out like this idiot, keep up the good attitude and learn from it.

I stood and admitted my fault to the prosecutor and judge. I am selling my Interceptor as part of my acceptance of what I did. Court is over, could have gone worse, could have gone better.

If I had any advice it would be no matter your situation or lifestyle, don't get caught doing anything in todays society. In Virginia today going 20 MPH over can get you a felony, welcome to the police state.

There is a generation of males, some of which I met whom are encarcerated and that is no way to live. 24 hours is like a week. As they said in Shawshank "time can draw out like a razor"

Last post, bike going home next week to another gent, good luck to all of you. If I get another VFR I'll surely come back.

    Rich in Virginia

ps- if you are just going to say some smartass shit about how I deserve it, save it I'm being hard enough on myself. I'll miss you guys.

I don't think there is a rule here where you HAVE to own a VFR to be a member. You may have lost your bike, but you haven't lost your insite and knowledge of these bikes and the VFR riding lifestyle.
Good Luck and don't be a strainger.
    Eddie.

Thanks so much guys. Part of all of this process, I consider it a process and not an event, is coming to terms with ones mistakes and making amends for them.

Some of why all of this has effected me so much is because I have been so careful the past 10 years, and never even really go out anymore. The flooding of the house put me under duress, much as the cancer death of my girlfriends' Dad did 10 years ago, he was dead within 3 days after my initial arrest, I almost had made it.

With all that said, pressure does not excuse one from good decision making, and I just hope on some level this makes me a better person and father. The definition of karate is perfection of character, that process never ends no matter what the situation. Losing one's freedom can leave a long lasting impact, which I guess is the point.

On the good end, my bike is selling next week to pay for upgraded flooring and a lawyer, and although I made a bad mistake the judge and prosecutor acknowledged that I was at least attempting to stay under the limit although I failed, and was close to the 10 years so they didn't give me 60 days and 3 years suspended.

Thanks to Michael especially and to all the moderators of this wonderful site. Vman, Reg you guys do a great job, this place is comfortable without getting out of control and everyone seems to know the boundaries. Ride well comrades, and God Bless all of our servicemen and women in theatre and those back here supporting them, without you there is no Republic to love.:usa2:
