    This one appears to have go viral...I've seen it on several sites already today. Does this mean they won't get their license?

    Bike rider was right. He was legally where he was, and his actions saved himself from serious injury or possibly death at the hands of not one, but two incompitent individuals. The driver of the SUV, and the driver trainer. For God's sakes, allowing the person to back the way they did in this instance. If you are already committed to an intersection before the light has turned red, you are to complete the move in safety and clear the intersection. Others are required to yield to a vehicle already in an instersection under these circumstances. Or so it is here, and I suspect most other jurisdictions too. Makes me want to suggest, that all drivier training should be in a driver training car where the trainer has access to the brake.

    But looking at the video, if you see the brake lights on the SUV, they came on well before the contact was made. This makes me believe that the driver was hitting the brake and the accelerator at the same time. I know this does not excuse the incompitence here, but just another thing to look at.

    I don't know what jurisdiction they were in, but here, I would have charged the trainer also with the exact same offence. Here we have a provision of "Care and Control" of a vehicle. I would argue that seeing as the driver was a trainee, and the passenger was the trainer, he had care and control. I don't know if I would win that one if disputed, but believe it would be worth the try. Traniers can't just sit back and claim they were not drivng. If they are that unsure of the driver, the driver should not be driving on a public roadway. The trainer could have refused to allow this.

    Two perspectives to this, even though its fairly clear which party is at fault.

    I have 4 children. Three of them have ridden with me in the past. Two of them have their licenses. One takes his driving education next week. Having been through a couple young driver experiences now, I can easily see how a new driver would;
    1. Panic.
    2. Not fully comprehend what he or she just ran over.
    3. Not see the motorcyclist.
    4. Is NOT at all ready for the driving portion with today's "Instructor" courses.

    New drivers are like wounded rabbits in a fox den. Do not be fooled by the ones that say "its cool, I got this". They're scared. The in the "classroom" training is only a week or two tops. And at that, kids 15-16 yrs old, are not 100% focused on learning how to drive safely, while their texting in classes, gossiping, being social, being "too cool for this kind of stuff".. etc etc. I'm equally positive that when the new driver was corrected and scolded, in the moment, for passing the white line and NOT proceeding through the light even after it turned.. he or she was in a situation that was NOT covered during the classroom training, save for a sentence or two. "..passing the white stop strip while the light is anything but red, is the same as proceeding through the light. Passing the white stop strip after the light turns red, is a moving violation equal to running the red light. Once a vehicle has entered the intersection legally, it is obligated to leave the intersection." Lastly, I have seen veteran drivers, NOT see a motorcyclists that was in plain view.

    Panicking, ill-instructed, seconds to react.. not looking. I can see it. Its not unfathomable.

    From the bikers point of view. Truly this is very unfortunate. He was smart to not continue with some other evasive maneuver which may have put him in harm in some other manner. Ditching the bike is the right move. It can be replaced.


    I want to believe I am a safe defensive driver. And while I can say what I would do, after having both the time to watch the video, and time to think about what I'd do.. that's a luxury the rider didn't have. Meanwhile, I remember being "not so great" when I began driving.

    There are more than one mailbox's in North Carolina, which I own now.

    Maybe she thought it was Randy on the bike. "The Giver of Citations" to whom the first law of legal physics should be regurgitated. "For every offense there is an equal and opposite defense".
