    Obviously, the motorcyclist is acting stupid BUT nothing he did justifies the cop physically assaulting him/wrestling him to the ground. Abuse of power 100%. Arrest him, take him in, whatever, but to get physical with him was unjustified.

    Y'all can ignore me if you want. At 18 I was a liberal democrat, at 38 I'm a conservative republican, and by 58 I'll be at the Ruby Ridge extreme, I suppose...

    The way I see it: The cop responded the way we ALL want to when hit by a dumb-ass. He just won't get arrested for acting out.

    While I'm normally the guy standing up for the civilian, all the cop did in the video was take him down when the rider tried picking up his bike. He could easily look to be a flight risk. I'd say the tackle was deserved just for being a dumb-ass.

    ok, there's a second video from another persepctive further back, which does show the cop being a little "enthusiastic" after the take down.

    At first I was thinking the same thing. So I went back over both a few times see nothing wrong with how the leo handled this. Police are supposed to respond with a level of force just higher that what they are greeted with. That is how they gain control. That is what we pay them to do. If that stupid ass on the bike's behavior is not aggressive then I just don't know what is. Look at what the cop was faced with. A couple dozen idiots all around him riding like complete jack asses on a busy highway. Many of you guys down there also are licensed to carry weapon so who the hell knows what could happen in a short period of time if the cop did not gain control.

    There is a huge difference with a cop in a crowd fighting with someone, and a cop in a crowd with control over someone.

    Being stupid in a no stupid zone......Wreckless endangement, Wreckless operation of a motor vehicle. Probably a lot more too. In a situation like this Cops will write a ticket for a lot of charges so when you go to court the judge will chose which fines you get to pay. For example if you only get a speeding ticket your chances of getting away are better than if you got a speeding ticket, expired tags, busted tail light ect. (not that I know from experience)

    This guy should also get his license to walk revoked too. Maybe Chelsea saw this guy and commented on what he was doing......

    Yeah, he definitely got "Chelsea'd" on that one. She was probably a passenger on the bike to the left and said, "Hey, bet you hurt yourself showing off in front of me."

    That really depends on where this happened as "most" traffic matters are a provincial or state matter. Unless you are dealing with something like dangerous driving or impaired driving.

    Going back 10 years when I retired from law enforcement, if that had taken place here, about all he could have been charged with, based solely on what I observed in the footage, would be our Drive Without Due Care and Attention. This in not criminal. It is a Motor Vehicle Act charge in which a ticket was written and served right then and there. It carried a fine of between $375.00 and $640.00 or something like that, and 6 points on your driver's licence. No court appearance unless you disputed the allegation.

    The kicker here is. If he disputed the ticket, it went to trial, and he lost the case in court, then the whole sentencing thing is now open for the sitting Justice of the Peace to increase the fine, and in fact, suspend the driver's licence. But no jail time. But this usually required the police officer, who prosecutes his own traffic matters here, to be prepared and when it comes to sentencing time, he needs to speak up and put forth his thoughts to increase the sentence. Otherwise the JP acts solely on his/her best judgement, and that may not be satisfactory. But too bad, if nothing is said before hand.

    I had been successful in upping penalties each and every time that I took a stand on stuff like this. But that was always when I could produce to the court, a bad recent driving record. Two or three speeding tickets over a 5 year period I did not bother. I have gotten 6 month and 1 year driving suspensions for speeding though due to the idiots driving record.

    Back then we did not have any laws specifically for stunting, but they may be on the books here now. I don't know, I don't care, I don't stunt.

    In the first vid you can see the leo leave his feet to tackle the guy who has him arms out in a 'who me' pose. The second vid shows the leo with the guy in a choke hold, after the helmet has been removed.

    I'm wondering if this is appropriate the next time I'm hit in a minor fender bender? Can I beat down the offender to take control of the situation if they have a friend or two with them in their car?

    Sorry, You and I must be looking at different videos. The leo was stepping over the front tire of the bike which was between he and the bike rider. And by no stretch of the imagination was that a choke hold. Leo had his right arm around the right side of riders neck, and his left arm under rider's left arm and chest. More a bear hug than a choke hold. Not that I would have had a problem with that anyways. The helmet. Who knows. It may have just fallen off or rider had unbuckled to remove or what ever.

    I think we are in a position of agreeing to disagree.


    BTW. A choke hold is when you have one hand against the back of the head, pushing it forward into the inside corner of your fore-arm and bicep in such a way you apply pressure to the carotid artery. Choke is poor commonly used terminology for the Carotid Controls Technique.

    Wow. That seems like pretty petty charge. Is there anyway that they can upgrade this to some type of felony here? Assaulting an officer or anything like that?
