    LEOs have active recordings to gather evidence and protect themselves from false claims and illegal conduct by the people they deal with. All perfectly legal and reasonable but if a private citizen records a LEO, in public and for the same reasons, now that's different...

    That is rather nutty...75 years, yet a cop that shot someone, while cuffed, laying down, and kills him, gets 2 years? What about all of the TV stations that film on duty officers? why can they not be punished? Is that not recording on duty officers? Oh wait, it is the media, not some guy standing up for his rights.

    Makes me ashamed to live in Illinois, the only state where ex governors make the license plates.

    I didn't care. Long as they didn't get me without my hat. Boss had a hissy if you didn't wear your hat. Here in CAnada, no one has an expectation of privacy when they are out in the public as far as video goes. AUdiou requires one party consent. Such as the person holding the recorder. Byt you cannot plant a bug in a room and record audio unless at least one person in that recording, is consenting to being recorded. Even in your own home.

    It may have been. Don't know, I was not there. It just seems pretty odd that if it happened to Average Joe, Joe would of gotten more time to think about what was an accident.

    EXACTLY! Without private citizen video, that incident could very well have come out all difference. How often has private video nailed a bad cop, like the clown who body slammed a biker then charged him with assault, or put the lie to the official record of events? Anybody who says the police video is enough should look to Oklahoma's Highway patrol and their track record concerning video in cases of questionable LEO conduct. Remember, in any instance of LEO said/Private Citizen said, court policy is to err on the side of the Officer. Private citizens need video for the exact same reasons as LEOs and that is why we are seeing this crap.

    If I remember correctly the only time that a person has to be notified that audio recording is in progress is in a place of business or Private building.. thats why you see stickers on all the doors " these premises are monitored by audio and visual recording...... public areas didn't matter....

    Dual Consent laws are the problem, where all parties being recorded must consent. Since LEOs never consent, especially when a screwup is involved, kaboom for the recording citizen. Also, there are public exceptions to many states' Dual Consent laws which, like in Maryland, are being ignored by LEOs and prosecutors. Bottom line, given crap like the rider who was prosecuted only after posting his video, this is nothing less than an effort by authorities to remove an tool (and in many cases the ONLY tool) effective against abuses of power.

    well, in regards to consent with the stickers,when you walk in to a store you have given consent to e recorded both audio and video, I wonder if you can get a ig sticker to but on the bike "Audio and video recording in progress for your safety and Mine, any communication constitutes consent to be recorded"... have to work on the wording.....LOL

    I would think the prosecutions are bad enough, jail time or no. Even if charges are dismissed or not guilty, the process costs money and causes grief, which is likely the intended point. It's not just about nailing someone as much as to give the next guy a good reason not to record at all.

    absolutely agreed.

    what should we do? therein lies the rub...

    we can't just kill all the lawyers and politicians can we? well, it's been done before, but it would be rather difficult now I'd think. I could go into politics, but I'd be corrupt inside a month. hmm, guess I'm gonna have to drink another beer and percolate on this.

    IMO what this guy will probably do is get that Vegas lawyer to get his "crime" pled down to a parking ticket..LOL

    That comment is plain ridiculous. If you were familiar with the court system, you would understand that. All the things said about videos up to now has some merit based solely on what is said here, assuming there is 100% credibility to it. And I see nothing to suggest it is or is not. But in Canada and the USA, any benefit of doubt must go and does go to the accused person. AS far as evidence being accepted in the courts, this is based on credibility of witnesses, be they police or civilian. The big difference here is that the police routinely give evidence in court. That is what they are paid to do. That means they are routinely scrutinized by not only defence, but the judges, the jury if there is one and even the prosecuting attorneys. And they are constantly scrutinized by the public they serve and 95% of the time, serve well.

    The accused person is likely to be before the courts once or twice. And if his credibility is tarnished by bad evidence, then oh well. He pays a fine or goes to jail, and in reality, for a short period of time. The police, if their credibility is damaged in the public or courts eyes, will unlikely ever regain that trust. Their job is fucked.

    Are there bad cops out there. Absolutely. I hope every one of them gets found out, fired and charges and convicted where appropriate. I wished other professions were held to the same level of accountability as police are. Perverted teachers are pawned of to other school districts. Bad doctors will practice elsewhere. Bad lawyers charge their clients more for their sleaze. Poor pilots, if they don't succumb to their errors, are placed in other administrative highly paid positions and the list goes on.

    Am I saying all those mentioned professions are bad. Not by any means. But they too have their bad apples. Lets keep our police accountable for sure. But give me a fucking break. If I could un-retire and go back to policing, I would in a heart beat and defend your right to say stupid things, so long as you are man enough to take some backlash. Are you?

    Randy, I've tried. The wife has had to keep me in check a couple of times while getting an unfounded ticket that I surely would of beaten the crap out of the cop. I may or may not have told the story before, but I had no choice to run a red light as I couldn't trigger the weight sensor. Went to court, dismissed. Now, my bro-IL is a cop, and arrogant. That is about the only way to put it. Is he a good cop/bad cop? Don't know, don't care, I don't talk to him or my sister except at funerals. Not over this issue, that is totally separate. Anyway, there are bad cops out there. But without being able to record them to show their superiors, there is no way for the common man to protect themselves. The cop is always deemed correct even if wrong. It was wrong of that cop to give me a ticket after sitting through 3 cycles of the light. at 12:30 at night, with nobody else around. Then out of nowhere comes 3 cop cars. To give me a ticket for running a red light. Or the IL State Trooper that said "I had ran from him a couple of weeks ago" when I had bought my bike 2 days before that....And as for the accused, it still is innocent until proven guilty, or supposedly is...

    are there bad people in every profession? You dammed well bet there are. Always the long running joke, of "what do they call the person that graduated #155 out of 155 for doctorate? Doctor." and the same goes for every other profession. There are those that just slide by, those that assist, and those that just get it done. It just seems as though we usually run into those that just are a$$hats, have a chip on their shoulder (like my BIL) more so than those that are more willing to give you a warning. Hell, I've got a friend that got pulled over because the 3rd brake light on his car was out. Still had the legally required two, and still got a ticket. no warning, a ticket. That is retarded. Hey - break light is out. Oops, my bad, I'll get it fixed. Well, get it fixed plus get this $75.00 (or whatever it is now) ticket. WTF!?!? Habitual offender...ok...already have a warning for it and not gotten it? OK, but....aarg!

    I mean, why is it up to us to prove the prosecutor wrong? (speeding tickets, moving or non moving violations, etc) They should prove them right that we were breaking the law. I knew I broke the law running that red light. No if, ands, or buts about it. I called the street department. Their reply was they were not going to reset it because then if a car clipped the sensor then that would cause others to wait when nobody was there. Now, isn't that then illegal lane useage because they crossed the center line? After said ticket, I annoyed the heck out of that PD. I would call them when I would get stuck at lights. the dispatch said to run it. HE-LL no. Told them I got a ticket, and I would not cross a 4 lane road because that was unsafe, and that I could be injured if there was a car coming that I did not see. Back to the topic...

    Will this guy get jail time? I would hope not. Let's save that room in that cell for some person that did some real bad things. You know, murder, rape, the sickos, some guy named BadBilly, or those that are of those caliber. Recording someone in public? How is that the local TV stations don't get in trouble for doing the same thing? Are they not recording police in action, maybe with sound? and there is the proof - broadcast on TV! welcome to our police state once again. What is good for the goose should be good for the gander, except where the government is concerned.

    Time to get off my soapbox and get to bed. This topic just so frustrates me. I think I should just unsub to this thread and let it go.....release the tension....calm...peace...

    Allow me to suggest an anodyne for your problems with the LEOs . Carry a 6" piece of gaffers tape with you. Apply liberally to the affected area. I can almost guarantee this will reduce the severity and possibly
    the frequency of getting popped for the alleged violations. Better that than having Big Bubba as a bunkie.
