    I'm sure they'll sort it out eventually and charges will be filed. It is second hand but the witness spoke with a local paper:
    "One witness who said she talked to the truck driver told The Arizona Republic that he appeared to be in shock after the wreck.

    "He told me he wasn't paying attention, just shuffling with his paperwork," said Tania Krukoff, an employee of a nearby Walgreens who rushed to the scene.

    Samudio said detectives have not been able to confirm the driver made that statement."

    Condolences to all the families and riders involved.

    Knowing full well you will have some lame justification or excuse for what you wrote, knock yourself out. The fact remains a guy on a bike bought it and others got hurt.

    There is a "no fault" update on this one on Google from early this month.

    Police: Truck driver on meth in biker crash

    PHOENIX -- Bond of $1 million has been set for a Scottsdale man, who police say was high on meth when his dump truck plowed into a group of motorcyclists stopped for a red light, killing four of them.

    Michael Jakscht, 46, was arrested Tuesday after police received the results of toxicology tests performed after the March 25 accident on the Carefree Highway at 27th Avenue.

    He was booked into jail on suspicion of four counts of manslaughter, five counts of aggravated assault and seven counts of endangerment.

    Police said Jakscht had been under surveillance while they waited for toxicology test results from the wreck.

    "The toxicology results confirmed that an illegal substance was present in Mr. Jakscht at the time of the collision," said Phoenix Police spokesman Luis Samudio. "The illegal substance is believed to be methamphetamines."

    Samudio said Jakscht was arrested after driving away from his Scottsdale home Tuesday. He said Jakscht appeared to be impaired when he was stopped and that more charges might be filed.

    Court documents, in the weapons or firearms box, listed a 24,000-pound 1996 Volvo dump truck.

    There was no sign that Jakscht hit the brakes before he ran over the motorcyclists and hit an SUV, the documents said. Some motorcycles burst into flames under the dump truck; others ended up scattered behind it.

    Three of the six brakes were out of adjustment, the documents said.

    Jakscht "showed signs and symptoms of impairment" at the crash scene, according to documents. Those included "high pulse rate of 116 beats per minute, dilated pupils, poor performance on the walk-and-turn test, including failure to maintain balance."

    The documents added that, "During his entire contact with the police on the day of the collision, the deefndant did not show any concern or remorse for the devastation and injuries that he caused."

    In setting the high bond, the court indicated it believes Jakscht could be a flight risk because he does not own a home and does not have a job in the Valley and has out-of-state ties.

    Thanks for the update. Notice his name - Jakscht (ie. Jack shit). I'm not sure how you actually pronounce it. I hope they just put this guy out of his and our misery. I wouldn't want our taxpayer dollars going to keeping this guy alive so he can get any perks, like an education, medical and dental, 3 squares a day, nothing. He doesn't deserve it. Some of the guys fighting overseas have it worse than he does and they're the ones protecting his freedoms. Ain't life a bitch.

    Feel free to do so. Make something up. Lots of blood and guts is always good. Try not to start with "It was a dark and stormy night" and try to diminish the focus you have about assholes. It's Freudian and telling. Include something about motorcycles too. That way you won't have any new readers thinking of you as the resident nutcase.

    I certainly feel bad for the ones that died and the others injured in this very tragic accident. (I know I might get some heat for this but..) I also feel sorry for the driver of the truck that caused this, This man has to live the rest of his life knowing he has killed people and seriously injured others by ( yet to be proven) careless actions. It is not like this is a combat zone killing trust me I have been there done that so I can only image how all involved are doing and my thought and prayers go out for a full and speedy recovery for the others

    This tragedy is going to go on and on for months on end until this matter is brought completely to its end in the judicial system. The grieving families will see no closure until this is over. And if your system is anything like ours, it is bound to go on yet for another several years with time delayed trials, appeals hearings and applications for exclusions for one reason or another. I hope and believe that the police did a stand up job in collecting evidence so that the defense cannot poke holes in their case due to poor or sloppy work. Now matter what happens here, the victims here are going to be victimized again and again until this is over.

    My thoughts still go out to the families, friends and co-workers of these souls.

    Humility is a quality that can be exemplified by admitting a wrong and attempting to make it right (ie. an apology). It's never too late to take the opportunity to make an amend.

    As for the guy driving the truck, killing and maiming all those people, he will surely suffer extreme consequences. However, nothing society can do to him will provide more than minimal comfort to the families of the victims. Their relief will only come from love and forgiveness from themselves and their family and friends.

    I have 17 years and counting of clean and sober time thanks to lots of things not including myself. During my drinking and drugging days I did some bad shit, hurt my parents and my brother and sister and others. If I got what I deserved, I wouldn't be here today. By the Grace of God I never hurt anyone physically, but given enough time I could have. This guy is one sick f*ck, and will suffer if her ever gets clean. Unfortunately for him and his victims, there is really nothing he can do to set this right, no amend big enough IMO.

    We can make a fairly safe assumption that the police did thier job correctly by the trickled in "updates". At the top of this entire thead and the other thread recounting another deadly incident. We have the vigilantes and dudes like this fool who has seen too many Dirty Harry flix responding and weenie wagging over specious "instant" media coverage.

    Indeed it is a professional opinion based on experience as a LEO. It is quite possible since you do not seem to be able to follow the chain of events with any certainty, it'
    s quite possibly it doesn't make any sense to you.

    Are you in the lethal injection or the firing squad school of thought? Life without parole maybe? Looks to me like the original press was co-written by three separate folks and now we see with evidence coming in and being analyzed that the dude was doing meth and his brakes were not up to spec. I submit that the update is the more accurate of the the original since it is very likely the second single reporter is assigned to the police beat which includes the district attorney and possible even the assigned prosecutor. Keep in mind that both are going for conviction under the law and may not wish to lay all thier cards on the table to a reporter especially l the likes of the three who "wrote" the original story and missed most of what happend.

    I also think you may be having a problem with what "evidence" is. The short version is, "That which tends to prove the fact in demand" .

    14 April 2010 Update

    A Maricopa County grand jury indicted a dump-truck driver on charges of manslaughter, aggravated assault and endangerment in the March 25 collision that killed four motorcyclists on Carefree Highway.

    Michael Jakscht, 46, was arrested April 6 by Phoenix police after a blood test revealed that the driver had methamphetamine in his system when his truck plowed through the group of bikers stopped at a red light at 27th Drive.

    Jakscht shaved his long hair and goatee, police said, in an attempt to change his appearance as police investigated the case. Investigators also believe Jakscht was addicted to meth, and that he might have been high at the time of his arrest.

    The grand jury indictment was handed up Tuesday in Maricopa County Superior Court, according to the County Attorney's Office.

    Jakscht drove for Fountain Hills-based Blue Sky Sanitation, which has declined comment.

    His 24,000-pound truck collided with a group of 10 motorcyclists stopped at a red light on westbound Carefree Highway as the group made their way to Lake Pleasant on one of their routine rides with M.C. Kruzer's motorcycle club.

    Three motorcyclists died at the scene: Clyde R. Nachand, 67; Stephen Punch, 52; and Daniel L. Butler, 35. Dayle Downs-Totonchi, 47, died one day after the accident.

    Phoenix fire Capt. Ernie Lizarraga, 52, who was riding with the group, remains in serious condition.
