New bike Finally arived and I got SCREWED!

    Wow. The lengths some people will go to make a dishonest buck.
    It sounds like the seller and shipper put alot into this scam to get very little in my opinion.
    Let's hope they run into the wrong kind of person very soon and get caught with their pants down.

    the military should have a list of shipping companies that are used all the time, they have good references AND they are insured. My ex had a car shipped to Panama, it got a few minor scratrches on it in transit. filed a clain\m and was payed....Have your son check his out processing branch..they will ahve a good list.

    Some questions, thoughts, etc:

    1) When the delivery truck arrived at your home, did you hop up on the truck bed and inspect the bike BEFORE it was taken down from the truck? If so, did you clearly see that the bike was obviously severely damaged, as delivered, and before it was unstrapped and taken down from the truck?

    2) Before you agreed to hire U-Ship's subcontractor in this case, were you presented with a contract that you reviewed and agreed to?

    3) Depending on your answer to question #2, did the delivery driver, upon arrival, present you with a shipping invoice, including a multi-point checklist of yes/no quality-assurance questions regarding the outward condition of the bike, BEFORE it was ever lowered off the truck and delivered into your possession? In other words, did you have the option of either accepting or refusing the delivery by signing on the appropriate line on the shipping invoice? (If you saw that the bike was in a heap and it was obviously severely damaged, while it was still strapped to the flatbed, did you accept the delivery of the motorcycle, as is, by signing off on the invoice as if the bike was in an acceptable and as-expected condition, when it was delivered to you? If so, you could be screwed as far as going after either U-Ship and/or the subcontractor.)

    4) As others have wisely asked here, did you have the forethought to thoroughly photograph the motorcycle while it was still on the truck, as well as to take some photos of the truck itself, the driver, as well as some photos the truck's license tags? Did you get the delivery driver's full name? (When shady persons and companies see cameras, they tend to suddenly get rather anxious and conciliatory.)

    If as you suspect, the bike actually fell off of the back of the truck at one or more points along the way, and it was dragged along for a while, it would be interesting to know if, while the truck and the spilled bike were delayed along a road or highway... and until the bike was put back on the truck... I wonder if this mishap ever came to the attention of a law enforcement officer who happened to be in the right place at the right time? If so, the truck driver could've been ticketed for, as but one example, an unsecured load.

    Ask your police friends to run the truck driver's license and truck tags for any violations. Might the driver have a history of other problems and citations, including DUI's? Does he have a valid Commercial Driver License (CDL) and have there been any other tickets on his CDL? You said that the bike was shipped over a distance of 3000 miles, and I right? At any rate, I'm rather suspicious of the possibility that the delivery truck driver might have a history of driving while "impaired" in some manner.

    5) As you surely know, it should be common knowledge that a motorcycle, car, etc., when towed on an OPEN trailer or flatbed, should almost never be covered with any sort of tarp, etc., because as the wind will continually flap these covers (as well as tie-down straps), and they will beat the shit out of the finishes underneath them. This is motorcycle towing/shipping 101, and the fact that this driver chose to convey your bike over the course of 3000 miles (let alone 30 miles) in such a manner is the mark of a rank amateur.

    Also, why in the hell was the bike ever placed 'horizontally" on the back of the flatbed? What the fuck is up with that? Any shipper with expertise in transporting motorcycles knows that a totally enclosed and well protected trailer or van is the absolute safest and best method of conveyance; that the bike should be transported upright, properly strapped and chalked down, and that on long hauls, the straps should be regularly checked and tightened, with attention to not damaging the front fork springs by over-tightening the front side straps.

    6) If your motorcycle actually fell off of the back of this delivery truck, and was dragged along, I think you should assume that the bike is essentially toast until proven otherwise by a thorough inspection through a reputable and qualified service shop. Have it's frame, forks, motor mounts, swing arm, etc. been bent or cracked beyond what the bike is now worth?

    7) I know that you feel really crestfallen over all of this, but it will do you no good to beat yourself up over it. We all make mistakes, and so we all live and learn. One thing I will say here is to beware of 'false economy', particularly when shopping on the Internet, which can be a real swamp. Trying to bring online cheats to justice may, for victims, be financially unfeasible in the long run. There are so many scams on the Web, and they rely on their unaccountability.

    When the shipper said "IT's not like it fell off the truck" that is your clue. What would make him think of THAT?
    That is exactly what it sounds like happened to me.

    Even just the damage from the tarp beating on it is still the truck drivers fault.
