Getting back at your neighbor

    OK so last March I get a 7 am wake up call from my neighbor beating on my door and him yelling at me "If your dog ever comes in my yard again I'm going to F'ing shoot it." Apparently she broke her chain and climbed a 5 ft fence and took a dump in his yard. He then says she attacked him by biting his ankle. (I think he tried to kick her and she snapped at him) Anyway I offer medical attention and he said "No." When I went over to clean the poo up he comes out and says he called the cops, an ambulance, and animal control. The cops said there was nothing criminal then left, the ambulance driver said to me, "some people...really we got called all the way out here for barely a scratch," and the animal control guy flat out refused to give me a citation (even though my neighbor demanded it).
    So a month later of course we get a letter from an attorney because he's suing me. (Mind you this old basterd doesn't have to balls to say any of this to me...I just get a letter in the mail). I call State Farm and they say don't worry we'll take care of it."
    Well I get a call today from State farm saying," we offered him $10,000.00 but he want's $30,000.00. So we're sorry but it looks like you're going to have to appear in court." He's a retired old prick and has nothing better to do but I have a life and have better things to do than go to court because he thinks he deserves $30,000.00 for a scratch on his foot. I've been bitten by a neighbor's dog before...they just paid my medical bills and no hard feelings. Whatever happened to being a community.
    Well as far as I'm concerned he just declared war. The best idea I've heard so far is salting his yard so all his grass dies. Are there any better ideas out there?

    counter sue for damages related to stress (yours) over something inconsequential like his lawsuit. i'm sure there's a crafty attorney in nashville that might actually MAKE you money. it sucks that it's still gonna cost you to get an attorney to fight this a@%hole! was he hospitalized for IV antibiotics? did he have to use crutches or a walker to assist in his 'painful' gait?
    i actually think this guy is fishing just to see what else he can get ontop of the $10k (probably his attorney talking there).
    he probably knows that you are a pilot so his attorney says, "let's try to get more". yup, yer gonna have to get an attorney. shit!

    No police charges? No citations from animal control and no trip to the hospital via the ambulance ought to be plenty of ammo for your State Farm guy to show this guy up as a nut case in court. Your State farm guy will coach you on all you need to do and know when it's Here comes da Judge time.

    Burning the dude's house down is not a good thing.

    What you could do before your day in court is to hire Cundalini for ten bucks a day and a short dog every four hours just to hang out in front of this guys house to show him you mean business.

    That’s a dog gone shame!! Maybe plant weeds all over his lawn, give him something to do, maybe there is a Lawyer on here to give you some good advice.

    Hmm... that is no bueno. My dog once got out and crossed a neighbors yard and when my brother who was chasing him ran across the yard, the neighbors dog bit my brother. It wasn't a huge deal, but my dog bit his dog to get it off my brother. Well I got sued for medical for his dog, so my bro counter sued for cut on his leg and torn jeans. I put my dog down because I knew the guy was gonna sue me anyway. Judge threw it all out. Nobody got anything which is what I wanted in the first place...but I hated to lose the dog.

    I can relate to your neighbors plight, though. I had a neighbor who always let his friggen dog loose and it would crap in my driveway or yard all the time. It was a nice dog, but that's friggen annoying when someone's dog is pooping in your yard. I on the other hand, would not think of suing, I'd probably just yell at you to keep your dog tied up or whatever. I think all these frivolous lawsuits are BS. Good luck, and hopefully the judge agrees with you. Make sure you have witnesses and documentation, that always goes a long way in court so I hear.

    Given what you've stated in your thread I would say you have little to worry about.

    I helped my Pops out a little while back with a suit over a used car that he had sold that was similar to your situation in the what little documentation existed all pointed to this dope suing my Dad being a moron. Dad was nervous since he's old now and can't hear too well.

    Anyways, the judge got so pissed at this dope for wasting the courts time I thought for a bit there he was going to jail him. Heehee

    So other than a pain in the ass court appearance you should be fine. And when it's over you can smirk your ass off all day long at your neighbor. No law against smirking, unlike if you decide to escalate the whole affair into nuclear territory.

    Well the good thing is this isn't going to cost me anything unless State Farm decides to up my home owners insurance. The state farm guy was cool as hell. He said not to worry they were providing the attorney and paying for everything. All I had to do was appear in court. He said my neighbor's attorney advised him to take the $10k but he wanted more. The joke's on him...I'm a regional pilot...if he kept up with the news he would realize mall security "rent a cops" make more money than I do.hehe!
    As far as his injuries go he never went to the hospital, he was out the next day on a ladder and walking his dog(I have witnesses) and the only "proof" of his injury is a picture of an infected scratch. He's retired and like to drive his motor home to Florida. I say he's just looking for gas money.

    What pisses me off is that it's not like I let my dog run wild through the neighborhood. The dog had to break her collar and scale a 5 ft fence (she is a boarder collie). I could see if this was something that happened regularly...anyway that's neither here nor there I found a new home for her.

    Yeah I know...I'm just venting a little. I think I'm just going to start rev my rc51 at all hours of the night. We live in the country so no noise ordinance!:vtr2:

    Or I'll take FLNVFR's advice and plant weed in his yard and call the cops. That's a great idea!! Get that old @sshole arrested for growing weed.

    I was in an accident (I bumped a guy in traffic) he tried the same shit . the judge ended up giving him half of what the insurance company offered and the judge lectured him for wasting the courts time...

    lol when my neighours dog takes a dump in my back yard, I just get my shovel and fling it back over my fence into his yard, all this time I could be trying to sue for 30 grand !!

Shame of it all is if YOU called the cops, you could have had him charged with a menicing charge. A dog is property in a commonwelth state, theatining to destroy someone's property is a crime.     Let's see what I have on my list...Up here in Canada where it freezes I pumped a liter of water into a deserving SOB's Left front tire; when it's liquid all is well, when it freezes back up, a really bad shimmy. A heavy elastic band with a nut on it fastened to the drive shaft at the tranny gives a simulated high speed failure. A cement mixer with a couple shovels of gravel in it running non stop. Simmilar with the lawn mover with the muffler off. How about some new high powered yard lights pointed in his direction 24/7? The teenage classic of a potato up the exhaust!! Just a few suggestions. I'd tell the State Farm guy to tell the neighbour to take a hike, if they pay you pay and that's not fair to you to have to pay higher rates and not have a say in the proceedings.

    Want to drive him crazier than he is? Buy a cheap video camera, heck, it can even be a plastic toy or one of the fake ones they use in stores. Mount it in one of your windows or on your house and point it directly at his house. Make sure he can see it. Make sure it has some cable and wires sticking out of it for effect. If he asks about it, tell him it's for security and it runs 24/7. Let the paranoia begin!
