Hey Toe, I know you want to send this back and get it over with, but I'd listen to the credit card company. Their returns department deals with this day in and day out, so they probably have a good feel for what might happen.

I wouldn't be surprised if there is some loop hole that if you return the product, then it is out of the credit card company's hands, then you are at the mercy of FosterRAD and their willingness, or lack there of, to give you your money back. I don't know if this true or not, but I'd wait for the okay from the card company.

What also wouldn't surprise me is if FosterRAD knows of a loop hole like this and is trying to trap you in it by getting you to sent it back. I must assume they have doctorate degrees in screwing people because they have done a good job of it. Does this call tag mean that return shipping is paid for? If not, try to get that also.

I work for a lighting manufacturer with products that cost over 4 times what this exhaust costs and we NEVER give this type of service to a client. Make sure the package is insured and that a signature is required for delivery. By insuring the package any damage can be claimed through the freight company. Taking pictures is the best first step. Keep in mind I wouldn't expect to get a refund until the product is returned. I would ask for a resolution within 3 days of their company receiving the exhaust. It shouldn't take much longer than that to inspect the system. If they truly stand behind their product then they would issue the refund without restocking fees once the exhaust is returned and then deal directly with Laser to resolve any issues. The customer (Toe Cutter) should have his money and be left out of any warranty issues FosterRad has with Laser Exhaust.

this whole story has been completely appalling in regards to customer service. the evidence is there that Toe Cutter has been trying to contact Foster over this issue and has received no response until the situation blew up on the forum. If at Toe's first letter or call the product was taken back for replacement or repair none of the negative comments would have been made. TAKE CARE OF YOUR CUSTOMERS!! the call tag was a good start since you are paying for the return and not Toe Cutter. Make sure the refund is quick as well and you may be able to save a little dignity.

    Tough call, Toe.

    1. Has your credit card company reversed the charges?

    2. If they have, and you decide to return the product, does that mean you will have a breach of contract (for lack of a better phrase) with the Credit Card company, and that they will no longer have to give you the money back (or can re-reverse the credit they've given you if FosterRAD were to submit the charge again)?

    3. It appears, based on Dr. Delgado's post above, that FosterRAD is paying for the return? That's a plus (again, for lack of a better word).

    4. Can you get written confirmation from FosterRAD/Dr. Delgado that upon you (Toe) returning the product, that this deal is done? (Assuming you are OK with simply returning the product, getting your money back, and not having to pay shipping costs). Or, you can take the offensive position, and send them a letter stating along the lines of "by returning this product, no future charges will be put through on my credit card, all previous charges will be reversed), etc. etc. Something along those lines.

If I were you, I'd be concerned about what your credit card company's position is on this. Aside from having an attorney - which costs money - the CC company is on your side, and that's a significantly stronger position than on your own.

You're integrability is evident, Toe. If you're gut is telling you to send it back, be who you are and do it.

If Dr. Juan is really concerned about making this right, a simple return label to get this problem rolling is not sufficient in this situation.

Toe Cutter has done absolutely nothing but prove everything he has said is 100% true. There are pictures galore of the system being defective through manufacturing, his credibility is more than established amongst us, and he has excellent records to prove what has been said and not done.

However FosterRAD has not proven their ability to be trusted. The return label being sent in advance is a small step towards proving that there is a small amount of dignity in the company however with what has been said and done so far, I dont think that it is enough to warrant Toe to send the system back, without any way a knowing he isn't being screwed after the system is sent.

If you want to make it right, cross ship him a new system. He has provided the proof the system is defective and won't fit. All he wants to do is get the system installed and the bike up and running. He has proven he is willing to send the system back. Now prove that you are truly willing to make it right. You have stated that you have the system in stock. That means it is ready to be shipped right out. Send him the new system before he sends the old one back.

Many companies do this all the time. It shouldn't be a big deal and it is an excellent way to give your customer a little bit of confidence that you truly do care and want to make it right.

I think he decided he no longer wants a laser exhaust system. I think his statement to the effect of, (paraphrasing) 'I just want to be done with this deal'.

Laser exhaust systems do look really nice on their website, though and they seem to be reputable. It's this whole FosterRAD deal that seems to be questionable. That and the questionable titles that are thrown around to imply integrity. As a medical professional, I am more than a little insulted at all the quote/unquote Doctors thrown around. Even a Phd I think needs clarification. Medical Doctors have lost credibility in our society and many of them leave their line of work for something less stressful where you don't have to worry about everyone trying to figure out how to screw you out of money. :soapbox: Those guys went to school for years and basically gave up a normal life to help people. Yeah, they make more money than most of us. But, (and I know this firsthand) they work A LOT. So to bring this back to topic, the Dr Robert and Dr Juan, etc... aggravate me if they are arbitrarily claiming titles they do not deserve to add repectability. And, while I respect an MD, I don't ask my colleagues about exhaust choices so throwing that MD on the email still baffles me.

Hey Drewl, you are an RN, can you reccommend a good TV set?

I wonder if this FosterRad person is a Dr of philosophy in exhaust engineering? Now that would be pertinent. Is there even such a thing?

Does your BA in BS trump FosterRAD's BS in sales?

These are difficult questions. Dr Juan Delgado, MD <--- who is this again? Well, if he has an MD then he can definitely recommend an antibiotic to me. However, why oh why would a Dr buy and exhaust company. Ok, maybe it was for a tax writeoff and he's a rider. I can respect that. For sure. Several of the Docs I work with are riders. But, here's where I run into a problem with this scenario. Most of the docs I work with want to be normal when outside the hospital so throwing your MD out on a correspondence where it is totally inappropriate and irrelevant just seems...uh...incorrect. This leads me to 1. suspect Dr. Juan Delgado is an alias 2. Dr Juan Delgado is truly a Dr and think throwing his credentials around will afford him with some credibility that Mr Juan Delgado would not be afforded. Now, if Mr Juan Delgado worked for 10 yrs in MotoGP as an exhaust design engineer he'd have way more cred IMO than Juan Delgado MD. I'm just sayin.

Does this FosterRAD company really believe we as a group are this dense? This is a bit insulting. How can a company like FosterRAD that has this many negatives continue to do business? I mean come on. I search their name on google and 4 out of 5 references are of a negative nature. It can't always be the buyers fault, can it? I understand that there are some dishonest pricks out there, but most of the time I would say the customer just wants a decent product for a decent price.

These guys (excuse me Doctors) at FosterRAD seem to be condescending to all of us, and I for one am insulted. Shame on you FosterRAD for pretending to be something you are not...a caring business. At least at first you showed your true colors. Now this second face of FosterRAD seems disingenuine or coerced. Where was this willing to compromise in the beginning FosterRAD?

FosterRAD, FosterRAD, FosterRAD, you see we here in this world wide web...we don't have much, but we do have this. We have word of mouth. We do have understanding of how search engines work FosterRAD. We do realize that every time we mention FosterRAD that, the search engines pick up on the tag FosterRAD and Laser exhaust and people hyperlink to us to find out about Laser exhaust and FosterRAD. FosterRAD....shame you used your name Mr Foster.... If this is indeed your business and not Dr Juan Delgado MD's business, perhaps you should investigate a few things. I have been investigating you and yours for a few hours and I am less than pleased with the results FosterRAD.

#1 You products look to be good however I will never try to purchase from you based on the problems aforementioned.
#2 FosterRAD apparently lies. Forgive me if I am wrong, but the proof is in the pudding so to speak and unfortunately for you, you played this game one to many times and someone kept eveidence of his treatment by FosterRAD.
#3 Laser seems to be a good product that is getting a bad rap because FosterRAD has a less than desirable way of treating customers when a defective product is received.

    Bad FosterRAD, Bad mojo.

I must say I am still very suprised with how Foster Rad has decicded to deal with this given all the negative feedback. The condescending tone in what has been posted is not what I would think one would use if truly wanting to save face and a customer or whats left of a customer base.It is cause for concern.

well, don't forget that you can be a doctor, but it is not always medicine. Look at Dr. Jones, he was a history teacher. Hell, for $10 I can become a reverend. I know a few Dr's of BS as well. I work at a hospital, and there isn't one of them here that use both the title of Dr. %name%, MD - which is staing Doctor Simth, Doctor.

He's no doctor. I could start signing my name esq. Just letters.

If you have had the charges revered on the credit card, I wouldn't send it back. The only place that would be shipped would be to the attic for about 5 years then shipped to the landfill.

hey reg, if i understand what your saying (and thanks for the extensive research & background checks) then Fosterrad is only a DISTRIBUTIOR of laser exhausts.

this explains many things...especially long lead times and delays, as he is simply 'clipping the ticket' when supplying product ex 'another country".

also if he has to return a product it is unlikely to be sorted easily for him as it would have to go back to country of origin etc..a big PIA for him, so he makes it difficult for the customer to get warranty on the item.

basically we should now start sending all the negative feedback direct to laser.

they will probably not be too happy to hear there name is mud...and from multiple sites, and all relating to foster rad..

pressure from the manufacturer end may be useful. at the very least he may lose his supply line.....which may save countless others...

    what you think?

    The tale of two doctors

Foster RAD called today on my cell phone and I missed the call but they called my employer and found their way to my supervisor.Funny, I never gave them the number to my employer. Dr. Delgado has a very thick accent so I know he is not Dr.Robert Foster, anyways after a very long phone call that consisted of wanting to know when I was going to ship it back, and then and only then he would refund my money, and when was I going post on the forum that he had refunded my money and all is well.
