    You are lucky to still be with us. PorscheBob is probably right. A good lawyer can subpoena her call phone records and tell for sure. Not one to immediately suggest a lawsuit, but this was pretty gross negligence that could have killed you or paralyzed you. Heal up and start thinking about that next VFR. :smile:

    Sorry to hear but certainly glad you are okay. I was rear ended in May and the frame of my 98 VFR was broken. I didn't have the same extent of damage as it seems you do. I chose to let my broken bike to go to salvage and used the insurance money to buy a 99 with 14,000 less kilometers on the clock a week after the accident. Be careful about trying to repair a bike that has been in an accident like yours. You never know what has been damaged. Good luck with your decision and again, so glad to hear you are okay.     Whew!!! dude, way to bounce the right way. Now go after her for all the damage that can't be seen for years to come. Trust me don't let her off, get a lawyer asap. don't let her Insurance Co. pay you off with minor damage, this could pay huge dividends in the future.     Thanks so much for all your comments guys, Im feeling better physically, still really sore but not limping quite so bad. The adjuster just came out, I think its ridiculous that I may have to pay them out of what they pay me to keep the bike. Stupid. Im beginning to think that the sentament echoed by several people here of getting a lawyer isnt a bad Idea. Im not a mean or vindictive person but seeing how the insurance companies just want to save their own asses and make a buck, a lawyer may help me be fairly represented. GAAAAA this sucks.

    Sorry to hear of the spill. Damn women are always on the damn cellphone not paying attention.

    I would get a lawyer sense she obviously was in the wrong to pay all medical bills and get you a brand new VFR..

    Lawyer up immediately. Any delay makes your case look weaker. You could have damage that may not manifest itself for weeks or months. There is no shame in protecting yourself and your family in this fashion. It's simply the safe and smart thing to do. My two cents, your mileage may vary.

    Back pain is a bad thing. My left shoulder is starting to hurt about a year and a half after my accident, just a couple months after my settlement. Some days are worse than others, but it always hurts to lift my arm above shoulder level. I hope your back heals up, ok. I think you really should get a lawyer for this particular case, just because of the back pain, alone. Make sure you get checked out for any soreness and stiffness that you have. Don't just shrug it off. Try to piece together how and where you were hit, and how you landed, and make sure everything is working 100%. The smallest of torn muscles in the right place can cause chronic pain in the future. I'd insist on a CT of the back, at least, if it hasn't already been done.

    On another note - damn, your chain is immaculate. That pic, alone, is evidence of severe emotional trauma.

    Your observation is right on. Insurance is a business. And the less they pay you , the more they make. They do it for a living all day every day.
    so you are playing on their field. Unless you have been through this B4, you don't even know the rules of the game.

    Got nuthin' to do w/ mean or vindictive. Has everything to do with fair.


    Also. the little girl who smacked into you. It would be good for her to realize that she could have just as easily Killed You.

    Wake up little girl...when you drive, you need to pay attention.
    Maybe if somebody takes a bite out of her - others will live.
