My 2007 R/W/B is down for the count

    Sad to say I have been riding R/W/B w/ABS #900155 for a little over a year and my daughter and I were hit on May 24th on interstate 270 in Dublin, OH. My VFR is totalled and the guy that hit us doesn't have enough insurance to cover the medical bills. I have uninsured/underinsured motorist coverage but it looks like that won't be enough either. :frown: :mad:

    I belive drivers with no insurance should lose the right to drive. Period!

    I really hope you and your daughter are okay. Like already said, a bike can be replaced. Was the driver of the car charged?

    Just because his insurance won't cover everything doesn't mean that he is not financially responsible for all damages and medical expense. Talk to a lawyer to see if you can file a civil suit against him for the difference. If you win in court I belive that his wages can be garnished.

    The important thing is that you and your daughter are still with us. I wish you a speedy recovery and hope you are not frightened enough to be able to climb back into the saddle one day soon.

    Thanks everyone. My daughter is in pretty good shape, she had a concussion, sprained ankle and multiple bruises. I, on the other hand didn't fair so well. I had a concussion, along with a broken left collar bone, 4 broken ribs, broken right hip and a sprained right ankle along with various bruises. Fortunately, both of us were wearing helmets and gear. My helmet did well, it wasn't cracked or broken but it was scraped/gouged on the chin bar, across the face shield, entire forehead, right side broke off the shield mount, scratched the left side and a deep gouge in the back left. My daughters helmet was ok, and both our jackets were barely scratched. I aslo had those kevlar riding jeans and they weren't scratched, but due to the accident they cut off our coats and clothes. She spent 1 night at OSU medical center. Unfortunately for me I woke up on the highway and the paramedics didn't like how I was answering questions so I was life flighted. Fotunately, all was well outside of the broken bones. I spent 6 days in OSU med center trauma and then I spent 12 days in OSU inpatient rehab, so for the next 2-3 months I will be off work and spending my time between a wheel chair and crutches. Everything works ok but I'm not allowed to walk due to the hip. Once I'm healed everything will be ok and I plan on riding again but it looks like it won't be til next year. I'm planning on buying my bike back but I'd like to find another RWB ABS model. I can give you the details of the accident if you want but I figure this post is already long enough.

    And yes Big3, I remember you, hopefully the seat is working out well. I made it to Deal's Gap last year and we were going back this year but obviously that has changed.

    As for liability, yes I can and at this rate plan on sueing the guy but unfortunately if he doesn't own anything it makes it very hard to collect.

    He doesn't have to own anything and if he is working the court can rule to have his wages garnished! Talk to a lawyer to see if this is allowed in your state under the circumstances!

    I am definitely glad to hear that neither you or your daughter have any life threatening injuries. However, what you're going through is tough to deal with. I wish you a speedy recovery. When you think you're up to it, please provide the details as it might help us all out in our everyday on-road experiences.

    I'm very sorry for your accident, It's more serious than I thougt, I do not kwow you but reading your mail I think you and tyour daugther are strong persons and will recover soon, I hope you can resolve things and return to your normal life as soon as possible.
    We the motorcyclist are a good group and I know you will have all the support, best wishes to your daugther and you.

    Glad you survived and that everything sounds like it will heal up. The important part is you both survived and will be ok, the bike is no big deal at this point and you'll be back on two wheels before ya know it.

    As for collecting from him, even if he doesn't have a job and is drawing unemployment, they can garnish his unemployment wages too.

    I hope that both you and your daughter get well soon and am very glad to hear that you will both fully recover. Hang in there my friend, try and keep as positive of an attitude as you can and heal quickly!! As most in this thread have stated, your and your daughter's health is the most important thing!!
